Any person aggrieved by a decision, final assessment, proposed revocation, suspension, or denial of a business license by the License Official may appeal the decision to the Committee by written request stating the reasons, therefore, filed with the Clerk to County Council within ten (10) days after service of the notice of the decision, final assessment, proposed revocation, suspension or denial.
The following requirements for submission of an appeal must be strictly complied with:
- The appeals must be in writing and state the reasons for the appeal.
- The appeal shall be filed with the Clerk to County Council within ten (10) calendar days after the payment of all applicable fees and penalties, or within ten (10) calendar days of notification of an assessment, charge-back of an audit, or notice of denial or revocation is received.
An appeal or a hearing on proposed revocation shall be held by the Committee within thirty (30) days after receipt of a request for appeal or service of notice of suspension at a regular or special meeting of which the Applicant or Licensee has been given written notice unless continued by agreement or by leave of the Committee. At the hearing, all parties shall have the right to be represented by counsel and to present testimony and evidence. There shall be no cross-examination of witnesses. The proceedings shall be recorded and transcribed at the expense of the party so requesting.
The Committee shall by a majority vote of members present render a decision based on findings of fact and application of the standards herein which shall be served upon all parties or their representatives in the same manner as notices in Section 15. The decision of the Committee shall be the final decision of the County.
The Committee may require additional information as deemed necessary to decide an appeal. Failure to submit adequate information upon request may be grounds for dismissal of an appeal.
